Environmental Legislation
In rfecent years, there has been a very noticeable increase in environmental legislation in the EU, of which many measures directly concern the aquaculture industry. Ignorance of these will not provide a legal defence for the fish farmer who contravenes the regulations and legislation.
At national and international levels, ways must be found to reduce the use of chemicals and other active products so that the farmer is able to cope with the production of wastes from fish farms. Otherwise aquaculture will acquire a tarnished reputation both in the eyes of the consumer and the legislator. The effects of such a situation could be numerous including falling market demand and poorer prices.
Legislation for aquaculture is intended to rule out uncontrolled developments that are harmful to all interested parties and, increasingly, in respect of public and consumer interests.
Noting that there are differences in national legislation in the different EU member states, laws exist that concern:
- control of farm biomass (standing stock);
- distance between sites;
- controlled use of disease treatments and dosage;
- fallowing periods and single bay management;
- disposal of mortalities and farm offal.
Other EU legislation exists as to the movement of live fish within the Community (concerning disease transfer) and the placing of fish and shellfish on the market (with respect to public health and consumer safety).
